Join us for an interactive discussion on the most common barriers to successful mediation\, including incomplete discovery\, unresolved medical treatment\, unrealistic case evaluations\, communication breakdowns\, emotional roadblocks\, and post-settlement complications. Our presenters will share practical strategies from both the advocate’s and the mediator’s perspectives\, including the effective use of reality testing\, BATNA/WATNA analysis\, brackets\, the mediator’s proposals\, and other techniques designed to move negotiations forward and maximize the likelihood of resolution. \nRobert E. “Bob” Cooper has tried well over 125 cases to a jury verdict\, defending a wide variety of claims\, over the course of his 48-year career. He has tried cases in most of Alabama’s 67 counties and in all three of the state’s federal district courts. Bob recently retired as a founding partner at one of Birmingham’s leading firms in favor of becoming a full-time neutral. \nAdolph Philip Reich II Upon graduating from the University of Alabama School of Law\, Philip joined a small firm and engaged in active trial practice for 16 years. During his trial practice Philip served as a Bar Commissioner with the Alabama State Bar\, served on the Executive Committee of the State Bar and was Chairman of one of the State Bar Disciplinary Panels.  Philip was elected to the bench in 1989 and served for over 20 years as Presiding Circuit Judge in Lawrence County\, Alabama.  He served on the Alabama Circuit Judge’s Association Board of Directors from 1998 to 2009\, and was chosen President of the Circuit Judges Association in 2008-2009.  Philip presided over more than 25\,000 cases\, including over 500 jury trials. \nThis course or a portion thereof has been approved by the Mandatory Continuing Legal Education Commission of Alabama for a maximum of 1 hours’ credit.
