When a witness testifies, whether at deposition or at trial, the witness swears under oath to tell the truth, the whole truth, and nothing but the truth. When I ask clients what they want to accomplish with their testimony, the most common answer is: “I want to get my story out.” As lawyers, we are tasked with helping our clients do that. Unfortunately, the opposing attorney asking questions has little interest in advancing your client’s truth, and we often struggle to provide our clients with the necessary tools to effectively communicate. While the lessons in here apply equally to depositions and trials, my focus here is on preparing clients for the single most important event in litigation – the client’s deposition.
