Sharon is President and Claims Counsel of Attorneys Insurance Mutual of the South, Alabama’s bar related legal malpractice provider. Sharon is also a founding partner of Christian & Small LLP. She is a past president of Alabama Defense Lawyers Association and the President-Elect of the Birmingham Bar Association.
Ethical Issues Defense Lawyers Face will use video vignettes that Sharon will then discuss proper handling of those dilemmas to avoid violations of the following ethical rules:
Rule 1.18(c) – duties owed to prospective clients, and avoiding ethical conflicts with current clients; and Rule 1.7 – determining whether a particular set of circumstances constitutes a conflict;
Rule 1.18(f) – defending under reservation of rights / duties under tripartite relationship and specific conflicts that arise under various circumstances;
Rule 1.16(b)(6) – lawyer’s duties when he learns client is or may be doing something illegal / duties of confidentiality, crime-fraud exception of Rule 1.2(d) / when withdrawal is the only option; and
Rule 3.7 – duties when lawyer is a fact witness / when is disqualification required, and what role if any can the lawyer play without disqualifying her whole firm?
This course or a portion thereof has been approved by the Mandatory Continuing Legal Education Commission of Alabama for a maximum of 1 hour’s credit, including 1 hour of ethics.
