Overview:
The tracking of larger verdicts now shows that traditional conservative venues, such as those in the southern states, have taken the lead in driving nuclear verdicts. Research indicates that some of the driving factors in these states is a general sense of dissatisfaction and a lack of control over the values in the country. When given an opportunity to “make a statement” jury members in these states are tending to declare a larger voice by awarding a larger verdict to a plaintiff with whom they can relate to and understand as having been taken advantage of or been mistreated.
There are a variety of factors that can help reduce the risk of a nuclear verdict. We will discuss: How to view the case from the Plaintiff’s point of view; getting the jury to like your client and your experts; combat the idea that “more should have been done” by explaining in detail WHY the client acted the way he/she did; educate your jury; use visuals and demonstratives.
