Speaker: Dr. Dan Cousin, MD

Dr. Dan Cousin is a dual-boarded, fellowship-trained Diagnostic Radiologist with nearly two decades of clinical and administrative experience, including roles as a private practice Medical Director and Residency Program Director at a Columbia University affiliate. Trained at top-tier institutions—graduating Magna Cum Laude from Harvard University, earning his MD from the Albert Einstein College of Medicine, completing residencies at Yale-Norwalk and UF Shands, and serving as Chief Fellow at Columbia—he is board-certified by both the American Board of Radiology and the National Board of Physicians and Surgeons. Currently in active clinical practice, Dr. Cousin offers rapid, same-day (<24-hour) radiology consultations, 4D demonstrative evidence, written reports, and expert testimony with a 50/50 plaintiff-defense balance. He has provided radiology testimony hundreds of times before juries across neuroradiology, body, and musculoskeletal imaging for cases involving Personal Injury, Medical Malpractice, Workers’ Comp, Criminal/Capital cases, Nonaccidental Trauma, and U.S. Military Courts-Martial.

Brief Course Description: This presentation highlights how defense teams can use radiology reports to challenge plaintiff injury claims, emphasizing that an overwhelming majority of allegations for spinal and brain trauma stem from normal, age-related degeneration rather than acute trauma. Radiologists frequently overread subtle 1 mm findings and omit chronic indicators—such as osteophytes, disc desiccation, loss of hydration, and endplate changes. True chronic wear-and-tear is further evidenced by multilevel changes, preserved spinal curvature, and findings concentrated in the mid-cervical or lower lumbar regions, whereas acute traumatic injuries present with bone marrow edema, ligamentous edema, or fractures on STIR sequences . Similarly, advanced brain imaging like Diffusion Tensor Imaging (DTI) and NeuroQuant—frequently used to allege traumatic brain injury—are not the standard of care for routine TBI clinical practice; they lack standardization, are operator-dependent, and frequently yield false positives due to normal statistical variation or unrelated conditions like aging, hypertension, alcohol use, covid exposure, and depression. To counter these plaintiff tactics efficiently, this lecture also covers several innovative strategies available to the defense that provide high value to defense attorneys and paralegals.
