Presenter: James R. Desmond, C.D.S., Senior Consultant

Overview: This course is designed to give adjusters and attorneys an overview of the components and systems of class 8 heavy-duty trucks, how the regulatory requirements of those components are applicable to interstate operations (the Federal Motor Carrier Safety Regulations, FMCSR), as well as state codes, legal out of service criteria (OOS), and why those components and systems are potentially important points of evidence to capture, preserve, and consider for litigation involving a class 8 heavy-duty truck collision. We will review the potentially available digital data, standard of care, safety components, what may be required under the regulations, what function(s) those components serve, and how each of those data points may apply to litigation. We will also discuss how data points come together for the totality of a crash investigation including downloaded crash data from a class 8 heavy-duty truck’s engine control module and anti-lock brake system.

This course or a portion thereof has been approved by the Mandatory Continuing Legal Education Commission of Alabama for a maximum of 1 hours’ credit.
